These Terms and Conditions govern your use of the Penpinnacle website and the services we provide. By accessing our website, placing an order, or purchasing any of our services, you acknowledge that you have read, understood, and agreed to these terms.

If you do not agree with any part of these Terms and Conditions, please do not use our website or services.

You must be of the legal age of consent in your jurisdiction to purchase or use our services. By placing an order or making a payment, you confirm that you are legally authorized to enter into this agreement.

By submitting an order or payment, you agree to be legally bound by these Terms and Conditions, which constitute the agreement between you and Penpinnacle.

Terms and Definitions

  • Website: Refers to all online pages, content, and information available through the Penpinnacle website.
  • Customer, You, or Your: Refers to the individual or entity purchasing or requesting services from Penpinnacle.
  • Company, We, Us, or Our: Refers to Penpinnacle and its authorized representatives.
  • Product: Refers to any service, deliverable, or other product provided to the Customer in accordance with an agreed order.
  • Order: Refers to a Customer’s request to purchase products or services from Penpinnacle through our website, telephone, email, or other approved communication channels.

Refund Policy

Our refund policy is designed to provide clarity and fairness regarding refunds for our products and services. Refunds are considered only under the circumstances and conditions outlined below.

Change of Mind

Customers may request a refund before our team begins work on their project.

If a cancellation request is submitted within 24 hours of purchase and no work has been initiated, the Customer may be eligible for a full refund, subject to applicable transaction or processing fees.

Once work has commenced, the Customer may no longer be eligible for a full refund because resources and working hours may already have been committed to the project.

Non-Compliance With Delivery Standards

If the delivered work does not meet the specifications or requirements agreed upon with the Customer, we will make reasonable efforts to correct the issue through revisions.

Where applicable, revisions may include editing, reworking, or adjusting the deliverables to bring them into alignment with the agreed project requirements.

If Penpinnacle is unable to fulfill the agreed requirements after reasonable revision attempts, a partial or full refund may be considered based on the circumstances and the portion of the service that could not be satisfactorily delivered.

Failure to Meet Delivery Deadlines

Penpinnacle aims to complete projects within the timeframe communicated to the Customer.

If a project is significantly delayed due to circumstances within our control and reasonable attempts to resolve the issue have been unsuccessful, the Customer may request a refund. Any refund eligibility will be evaluated based on the project status and supporting documentation.

Delays caused by the Customer, including late responses, missing materials, approval delays, or changes in project requirements, may extend the original delivery timeframe.

Refund Request Timeline

Refund requests must generally be submitted within 10 days of the applicable product or service delivery.

Requests submitted after this period may not be considered.

Circumstances Where Refunds May Not Apply

Refunds may not be provided for minor issues such as typographical errors, minor formatting concerns, or technical difficulties that are temporary or outside Penpinnacle’s reasonable control.

Where appropriate, such issues may instead be addressed through revisions or other mutually agreed solutions.

Customers are responsible for ensuring that materials submitted to Penpinnacle do not violate applicable laws or third-party rights. Penpinnacle is not responsible for unlawful, unethical, or unauthorized use of delivered content by the Customer.

Project Closure

If a project remains inactive for 20 consecutive days due to a lack of communication, approvals, materials, or required information from the Customer, Penpinnacle may consider the project closed.

Reactivation of a closed project may require additional fees and may be subject to the availability of the assigned team.

Completed Projects

A project may be considered completed once the agreed deliverables have been provided to the Customer.

If a completed project remains unclaimed or receives no communication from the Customer for 10 days, Penpinnacle may consider the project closed and may no longer be responsible for further revisions or modifications unless otherwise agreed.

Personal Use and Copyright

Unless otherwise specified in writing, the Customer retains ownership of the original content and materials supplied by the Customer.

The Customer is responsible for ensuring that all materials submitted to Penpinnacle are legally obtained and do not infringe upon the copyright, trademark, privacy, publicity, or other rights of any third party.

Penpinnacle’s proprietary materials, systems, processes, branding, website content, and other company-owned resources may not be copied, reproduced, redistributed, or used without authorization.

Plagiarism and Copyright Compliance

Penpinnacle does not knowingly participate in or encourage plagiarism, copyright infringement, fraud, or other unlawful activities.

Customers are solely responsible for the legality and originality of materials they provide to us. Any legal, academic, professional, or other consequences resulting from the Customer’s unauthorized or unlawful use of content are the responsibility of the Customer.

Image and Visual Content Policy

Penpinnacle does not claim ownership of third-party photographs, illustrations, or other visual assets unless such materials are specifically created by Penpinnacle or licensed to us.

Where appropriate, we may recommend royalty-free or third-party visual resources. Customers are responsible for reviewing applicable licensing requirements before using any third-party images or assets.

Revision Policy

Penpinnacle may provide revisions according to the scope of the purchased service and the agreed project requirements.

Editing Services

For editing projects, revisions are intended to address objective or technical issues related to the agreed scope of work. Requests that substantially change the original content or project requirements may be treated as additional work and may incur additional charges.

Ghostwriting Services

For ghostwriting projects, reasonable revisions may be provided to ensure the content aligns with the agreed brief and requirements.

Once the Customer has approved the content, substantial changes to the approved material may be considered additional work and may be subject to applicable editing or rewriting fees.

Limitation of Liability

The Customer agrees to hold Penpinnacle, its employees, representatives, contractors, affiliates, and service providers harmless from claims, losses, damages, or expenses arising from:

  • The Customer’s misuse of our website or services.
  • Materials or information supplied by the Customer.
  • Violations of these Terms and Conditions.
  • Violations of third-party intellectual property or other legal rights.
  • Technical failures, network interruptions, email issues, or circumstances beyond our reasonable control.
  • Unauthorized use or distribution of delivered materials by the Customer.

To the extent permitted by applicable law, Penpinnacle shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website or services.

Amendments to These Terms

Penpinnacle reserves the right to modify, update, or amend these Terms and Conditions, policies, and related agreements at any time.

Updated versions may be published on our website. Customers are encouraged to periodically review these policies to remain informed about any changes.

Penpinnacle may also use representatives or professional names appropriate to the region or market in which they communicate with customers.

Email and Mobile Communication Policy

This policy explains how Penpinnacle may use email addresses and mobile phone numbers provided by customers.

Consent and Communication

By providing your email address or mobile phone number, you consent to receive communications from Penpinnacle related to your services or projects.

These communications may include:

Carrier Charges

Standard messaging and data charges may apply depending on your mobile service provider. Customers should contact their carrier for information regarding applicable rates.

Stop and Unsubscribe

You may stop receiving communications at any time.

For email communications, use the Unsubscribe link provided in applicable emails.

For SMS communications, reply STOP or UNSUBSCRIBE where supported.

Communication Frequency

Penpinnacle aims to keep communications at a reasonable frequency. Additional messages may be sent when necessary to provide important project updates, request approvals, or address urgent service matters.

Security of Information

Penpinnacle takes reasonable measures to protect customer contact information. We do not knowingly sell or disclose customer contact information to third parties except where necessary to provide services, comply with legal obligations, or otherwise permitted by applicable law.

Policy Changes

Penpinnacle reserves the right to modify this communication policy when necessary. Any updates may be published on our website.

Publishing Agreement

This Publishing Agreement (“Agreement”) is entered into between Penpinnacle (“Publisher”) and the customer (“Author” or “Customer”) for the provision of publishing-related services.

  1. Scope of Services

Penpinnacle may provide publishing services according to the agreed project scope, including but not limited to:

  • Editing
  • Manuscript formatting
  • Book cover design
  • ISBN assistance
  • Publishing support
  • Distribution support
  • Digital publishing services

The exact services provided will depend on the package or project agreed upon by the Publisher and Customer.

  1. Author’s Responsibilities

The Author is responsible for providing all required text, manuscripts, images, artwork, and other materials necessary to complete the project.

The Author confirms that submitted materials:

  • Are original or legally obtained.
  • Do not knowingly infringe upon third-party rights.
  • Have all necessary permissions and licenses where applicable.
  • Are not knowingly plagiarized, forged, or unlawfully copied.
  1. Copyright and Ownership

The Author retains ownership of the original materials submitted for publication, subject to the terms of any separate written agreement.

The Author grants Penpinnacle a limited, non-exclusive right to use, reproduce, modify, format, and distribute the submitted materials solely as necessary to provide the agreed services.

  1. Indemnification

The Author agrees to indemnify and hold harmless Penpinnacle, its employees, contractors, agents, and affiliates from claims, losses, damages, or expenses arising from:

  • Alleged copyright or intellectual property infringement.
  • False, misleading, defamatory, or unlawful content supplied by the Author.
  • Violation of third-party rights.
  • Unauthorized or unlawful use of submitted materials.
  1. Limitation of Liability

Penpinnacle is not responsible for losses resulting from unauthorized access, distribution, leaks, theft, or misuse of Customer materials when such events occur outside our reasonable control.

  1. Confidentiality

Penpinnacle takes reasonable measures to protect the confidentiality of customer materials.

However, no method of electronic transmission, storage, or communication can be guaranteed to be completely secure. Customers are encouraged to submit only the materials necessary to complete their project.

  1. Termination

Either party may request termination of the agreement through written communication.

Upon termination, Penpinnacle will cease further processing or distribution of the Customer’s materials, subject to the status of the project, services already performed, applicable fees, and any separate written agreement.

  1. Governing Law

This Agreement shall be governed by and interpreted in accordance with the applicable laws specified in the parties’ written agreement or, where no separate agreement exists, the applicable jurisdiction governing the Company’s operations.

This document represents the general terms governing the relationship between Penpinnacle and its Customers and may be supplemented by individual service agreements, invoices, or written project terms.
